Rant: The 'it'll settle down' excuse for leaning trees on new builds

I keep seeing guys leave 3-inch oaks with a 15 degree lean that were planted two summers ago in Austin, and they claim the roots will anchor once construction traffic stops, but I've dug up two of those this fall and the root balls were just spinning in loose fill dirt, so am I being too strict about recommending immediate cabling or bracing?
