Kept a folder of every lease I signed since 2019 and finally sat down with a tenant rights lawyer in Fresno
For years I just kept every lease, notice, and email in a shoebox under my bed and figured I would sort it out if anything ever went sideways. Back in 2019 my landlord in Fresno tried to keep $1,400 of my deposit over carpet stains that were already there when I moved in, and I had nothing organized so I just ate the loss. After that I started dropping everything into one folder, every signed lease, every text about repairs, every photo with a date on it. Last month a friend referred me to a tenant rights lawyer and I walked in with the folder, and she flipped through it in about ten minutes and found two clauses in my current lease that flat out do not hold up under state law. She said the folder was the reason she could help at all, because most people show up with nothing. It was a small win but it felt huge. Has anyone here had luck pushing back on a lease clause that clearly broke the rules, and did you handle it yourself or get a lawyer involved?
Did your lawyer say anything about how far back you can go with old stuff? My buddy had a similar folder situation and his lawyer found a clause about entry notice that was straight up illegal, got his landlord to back off on some fees without even going to court. Sounds like just having it all in one place is half the battle.
